#122. The Fair Debt Collection Practices Act does or doesn't cover noise-based collection practices.

We're certain there exist law-abiding or honest debt collectors... there has to be.  This is not directed at them.  The "allegations" below are meant for those who do the following:

  • Broadcast or play suggestions or messages 24 hours a day, 7 days a week in neighborhoods or apartment complexes.  For example:
    • "...if you're not supposed to be here... go home..."
    • "...if you're home is somewhere else... go there instead..."
  • Use suggestions or messages containing insults or taunts.
  • Evade debt collection laws by delivering suggestions or messages at volume levels below or above ranges considered typical for humans.
  • Use techniques to identify when a homeowner or resident is away for purposes of entering, theft, or simply to make sure those living there know their home was entered.
  • Leave suggestions or messages intended to be heard or perceived as:
    • "...you're gonna give us something to use against you..."
    • "...for being a good sport... lost your job because of what we did..."
    • "...this isn't the first time we've done this... never been caught..."

It's technically illegal for a debt collector to harass or threaten someone.  Unfortunately, there exist debt collectors who don't care about technicalities.

Knowing the intent or spirit of laws like the FDCPA doesn't deter such behavior even though noise-based harassment fits the bill.

See if you recognize the phrases used in the clips provided.  They don't match standard cold call scripts.

Here are 3 names heard in St. Louis during instances such tactics were used.  We don't know if they belong to individuals directly or indirectly associated with debt collection.  The names may be a misdirection or other attempt to avoid responsibility.

  • Elizabeth or Beth Kunce (aka "Beth")
  • Susan Freeman (aka "Sue")
